These Terms & Conditions ("Terms") govern your access to and use of the AlbumLink platform ("Service") provided by VITA Tech Solutions ("we", "us"). These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and do not require any physical or digital signature.
1. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. By creating a lab account, you represent that you are authorised to bind the lab/business you represent.
2. Account Registration
- You must provide accurate, current and complete information.
- You are responsible for maintaining the confidentiality of your password.
- You are responsible for all activities under your account.
- We may suspend or deactivate accounts that breach these Terms or with unpaid invoices.
3. Pricing & Billing
- Albums are billed at the published rate (currently ₹20 per album per 6-month link), exclusive of applicable GST.
- Invoices are generated monthly and are payable within 7 days.
- Overdue accounts may receive in-app warnings and may be deactivated.
- Link renewal beyond 6 months is charged at the prevailing rate.
4. Lab Responsibilities & Content Ownership
- You retain all rights in the photos, PDFs and customer data you upload.
- You grant us a limited licence to host, transmit and display such content solely to provide the Service.
- You warrant that you have all necessary rights, releases and consents from the customers and individuals depicted.
- You must obtain valid consent from data principals before uploading their personal data, as required by the DPDP Act, 2023.
5. Prohibited Content (Rule 3(1)(b), Intermediary Guidelines 2021)
You shall not host, upload, share or transmit any information that:
- Belongs to another person and to which you do not have rights.
- Is obscene, pornographic, paedophilic, defamatory, invasive of another's privacy, insulting on the basis of gender, racially or ethnically objectionable.
- Harms minors in any way.
- Infringes any patent, trademark, copyright or other proprietary rights.
- Violates any law for the time being in force.
- Deceives or misleads the addressee about the origin of the message.
- Threatens the unity, integrity, defence, security or sovereignty of India.
- Contains software viruses or any other malicious code.
We reserve the right to remove non-compliant content and report it to the appropriate authorities.
6. Intellectual Property
The AlbumLink brand, logo, software, UI and all associated intellectual property are owned by VITA Tech Solutions. No part of the Service may be reproduced, reverse-engineered, or commercially exploited without prior written consent.
7. Service Availability
We aim for high uptime but do not guarantee uninterrupted service. We may perform maintenance, updates or modifications without prior notice.
8. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service shall not exceed the fees paid by you in the three (3) months immediately preceding the claim. We are not liable for indirect, incidental, special or consequential damages, including loss of data or business.
9. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or damages arising out of your breach of these Terms, your uploaded content, or your violation of any law or third-party right.
10. Termination
Either party may terminate the account on notice. Upon termination, your access will be revoked and your data may be deleted after the retention period set out in our Privacy Policy.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to the consumer protection laws, the courts at Hyderabad, Telangana shall have exclusive jurisdiction over any disputes.
12. Grievance Redressal
Complaints regarding the Service or any content may be addressed to the Grievance Officer at support@vitatechsolutions.com. We shall acknowledge complaints within 24 hours and dispose of them within 15 days as required by the Intermediary Guidelines, 2021.
13. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
